WORKER’S AFFAIRS OFFICE DATA PRIVACY STATEMENT

PERSONAL INFORMATION COLLECTION

Please be advised that in order to serve you better, the WAO are collecting the following personal information from you when you sign up, open an account, or electronically submit to us for any inquiries or requests. These Terms are effective as of December 1, 2024:

• Employment Details
• Government ID
• Selfie with Government ID

USE AND DISCLOSURE

The collected personal information is utilized solely for processing, emergency response and documentation, and contact tracing of residents of the City in compliance with existing Laws, City Ordinance, Rules and Regulation, and is not shared with any outside parties other than the authorized PIC and PIP in compliance with Data Privacy Act, its IRR, NPC Circulars, Issuances, and Requirements. This information enables us to properly process the registration, inquiries, and/or requests, forward it to the appropriate office, or the Data Privacy Officer, for appropriate action and response, and provide the clients or complainants with appropriate updates and advisories by personal service or interaction, e-mail or telephone call in an orderly and timely manner. In accordance with your communication preferences, we will occasionally contact you to provide update status of your registrations, announce new features we build for you, if any, inform you of activities and programs, and share tips and information.

PROTECTION MEASURES, STORAGE, RETENTION AND DISPOSAL

The Worker’s Affairs Office does not share the registrants’ personal information with any third parties for their own advertising purposes. Only authorized personnel of the Worker’s Affairs Office and City Government of Valenzuela shall have access to personal information processed herein. The personal information collected are stored in individual offices that collect the same. For digitally processed information, the personal information is stored in the Worker's Affairs Office.

Personal Information collected are retained and shall be deleted in our database and in Cloud Storage immediately after the fulfillment of the declared, specified, and legitimate purpose, or when the processing relevant to the purpose has been terminated. Any information collected shall be destroyed and disposed via use of a shredder, or any other means and methods allowed by law and that the information contained therein can no longer be recovered, should be unreadable (for paper) or irretrievable (for digital records). However, information shall be archived for reference and research purposes only. It is the organization's duty to make sure that data will be disposed properly in a way that the data should be unreadable (for paper) or irretrievable (for digital records). The organization should categorize whether the data they have are high-risk or low-risk. It is recommended that the appropriate data disposal method be used.

RIGHTS OF DATA SUBJECT

You have the right to be informed, to access, to amend, to object, to erasure or blocking, to damages, to file a complaint, to rectify, and to data portability with the understanding that there are procedures, conditions, and exceptions to be complied with in order to exercise or invoke such rights. Provided that registered personal information has not been erased.

You have the right to ask for a copy of any personal information we hold about you, as well as to ask for it to be corrected if you think it is wrong. To do so, please contact the WAO.

PRIVACY RISKS

• Attacks on the Database Storage;
• Hijacking of COV's Website Cloud Storage;
• Unauthorized disclosure of GOV's personnel;
• Scanning errors related to inter-connection with other local government units;
• Technical errors such as log-in failures, lost passwords, QR scan transmission failures and the likes.

By accessing or submitting a Request for Application (RFA) to any employees and employers residing in Valenzuela City with Workers and Employers Affairs Management Platform (WEAMP), you acknowledge and agree to comply with the terms and conditions set forth in this document.

These terms govern your use of the WEAMP Website, as well as any communication, including emails, between you and WEAMP. These Terms are effective as of December 1, 2024. Under no circumstances shall WEAMP be held liable for any direct, indirect, special, incidental, or consequential damages, including, but not limited to, loss of data, profits, or any other losses, arising from the use or inability to use materials on this website, even if WEAMP has been advised of the possibility of such damages.

If your use of materials from this site requires repairs to your equipment or data, you will be responsible for any associated costs. WEAMP reserves the right to alter pricing and update the resource usage policies at any time.

II. License

WEAMP hereby grants you a limited, non-exclusive, non-transferable, and revocable license to create an account and use the website strictly in accordance with these Terms and Conditions. This agreement constitutes a contract between you and WEAMP, and by using the service, you agree to abide by its provisions.

• A. License, sell, rent, lease, distribute, or otherwise commercially exploit the service, or make it available to third parties.
• B. Modify, disassemble, decrypt, reverse compile, or reverse engineer any part of the service.
• C. Remove or alter any proprietary notices, including copyright or trademark notices, associated with WEAMP or its affiliates.

IV. Your Suggestions

Any feedback, suggestions, or ideas (collectively "Suggestions") provided by you regarding the service shall remain the exclusive property of WEAMP. WEAMP reserves the right to use, modify, or redistribute these Suggestions for any purpose without any obligation to credit or compensate you.

V. Your Consent

By using our services and registering an account, you consent to these Terms and Conditions. We have updated our Terms to ensure transparency about how your data is collected and used.

This Agreement remains effective until terminated by either party. WEAMP may suspend or terminate the Agreement at its discretion, and you may stop using the service at any time. If WEAMP disables your account, you may lose access to your account and any associated data. Termination does not affect any accrued rights or obligations.

XII. Copyright Infringement Notice

If you are a copyright owner and believe that any content on the WEAMP platform infringes on your copyright, please notify us with the required information, including a signed statement of good faith and the details of the alleged infringement.

XIII. Indemnification

WEAMP’s liability, under any provision of this agreement, is limited to the amount you have paid for the service. WEAMP and its suppliers are not liable for any indirect, incidental, or consequential damages, including loss of profits or data, arising out of your use of the service.

XIV. Limitation of Liability

Our platform may feature third-party content or services. WEAMP is not responsible for the accuracy, completeness, or legality of these third-party services, and any use of such services is at your own risk.

XV. Severability

If any provision of this Agreement is found to be unenforceable, the remaining provisions will continue in full force and effect.

XVI. Waiver

Failure to exercise any right under this agreement shall not be considered a waiver of that right, nor shall it affect future exercise of that right.

XVII. Amendments to this Agreement

WEAMP reserves the right to modify or replace this agreement at any time. If a material change is made, we will notify you in advance, and you will have the opportunity to review the new terms. Continued use of the service constitutes acceptance of the revised terms.

XVIII. Entire Agreement

This Agreement constitutes the entire understanding between you and WEAMP regarding the use of the service and supersedes any prior agreements. Additional terms may apply if you use other services provided by WEAMP.

XIX. Intellectual Property

All content on the WEAMP platform is owned by WEAMP or its licensors and is protected by copyright and intellectual property laws. Unauthorized use of the platform's content is prohibited.

XX. Agreement to Arbitrate

In the event of a dispute, you agree to resolve the issue through binding arbitration, rather than in court, except for claims related to intellectual property rights.

XXI. Binding Arbitration

Disputes that cannot be resolved informally will be settled by binding arbitration, where you waive the right to litigate in court. Arbitration costs and attorney fees will be borne by the non-prevailing party.

XXII. Links to Other Websites

Our service may contain links to third-party websites that we do not operate. We are not responsible for the content or practices of these websites. We recommend that you review the terms and conditions of any third-party site you visit.

XXIII. Submissions and Privacy

If any provision of these terms is deemed unenforceable, the remainder of the agreement will remain in effect. Any waiver must be in writing and signed by an authorized representative.

WEAMP is not responsible for any inaccuracies or damages related to the service. The service is provided "as is," and we do not offer any guarantees or warranties regarding its use.
